A "service customer" is the person or company that's actually paying for the hosted service.
When you purchase POP Forums services, you agree to recurring monthly charges until you cancel the renewal. In the event that you exceed usage limits, you will be charged for the next highest plan that will accommodate your usage. POP Forums is not responsible for any fees associated with your banking accounts. All sales are final and not refundable. In the event that POP Forums can not charge your payment method for services, your forum will be deactivated.
You own the data and content created as a product of using POP Forums services. You may request a copy of the data from POP Forums by electronic notice, and POP Forums may require a fee to export this data. POP Forums agrees to export the data within 30 days of receipt of the fee. POP Forums will not sell the data to any third parties outside of a complete sale of the service to another company, in which case it will make a good faith effort to ensure that these terms continue to be enforced.
POP Forums will in good faith keep the service running at all times, but in the event of a complete service failure, meaning your forum is generally not available on the Internet, POP Forums will refund that month's fee on the following schedule:
While POP Forums will in good faith attempt to maintain the persistence of data created through its system, you acknowledge that it is possible for catastrophic failure to occur that could result in the loss of data.
You are ultimately responsible for moderating the content on your forum, however, POP Forums reserves the right to remove any content that violates the end user terms of service, or otherwise violates the law or creates an unsafe or dangerous scenario. POP Forums may deactivate your forum if it consistently finds content that violates the end user terms, and will issue a refund at that time. POP Forums will forward DMCA requests to you. You assume all risks in using POP Forums and operating a forum on our platform. You, and on behalf of yourself, and all agents, heirs, successors and assignees voluntarily agree to release, hold harmless, defend and indemnify POP Forums and its agents, heirs, successors and assignees from any and all claims, actions or loesses arising from use of POP Forums and its services.
POP Forums makes no representation about the suitability of POP Forums for any use and is provided "as is" without any warranty, expressed or implied.
